Program Terms and Conditions
1. The Program
1.1 The GROHE Designer Program (the "Program") is a loyalty program offered by AS America, Inc., operating the LIXIL Americas brands, including GROHE ("LIXIL" or the "Sponsor"). The Program is administered on LIXIL's behalf by Prairie Group Inc., d/b/a Bubblehouse ("Bubblehouse" or the "Administrator"), which operates the Program website, processes claims, issues rewards, and provides participant support.
1.2 The Program rewards eligible residential interior design professionals with points for validated sales of eligible GROHE SPA products, including eligible GROHE SPA products in client specifications, and for other engagement activities described on the Program website (the "Site"), currently located at designers.grohe.us (United States) and designers.grohe.ca (Canada).
1.3 These Program Terms and Conditions (the "Terms") govern participation in the Program. By enrolling in or participating in the Program, a participant agrees to these Terms, the LIXIL Privacy Policy, and any additional rules posted on the Site. If a participant does not agree to these Terms, the participant may not enroll in or participate in the Program.
1.4 The Program is offered in the United States, including the District of Columbia, Puerto Rico, and Canada, excluding Quebec.
2. Eligibility
2.1 To be eligible to participate, an individual must, at the time of enrollment and throughout their participation in the Program:
2.2 The following persons are not eligible: employees, officers, directors, contractors and agents of LIXIL, its parents, subsidiaries and affiliates, of the Administrator, and of any agency or company involved in the development or execution of the Program, together with the immediate family (spouse, parents, siblings and children) and household members of each of them; participants currently enrolled in the Enjoy More Rewards showroom associate program; employees of GROHE SPA showrooms and authorized dealers; and any person purchasing GROHE SPA products for resale.
2.3 LIXIL may verify eligibility at any time and may request additional documentation. LIXIL may, in its sole discretion, decline an enrollment or suspend or terminate an account that does not meet these eligibility requirements.
3. Enrollment and Account
3.1 Individuals may enroll by completing the registration form on the Site, which requests the participant's name, company name, email address, mailing address, country of residence, any tax information required for tax reporting purposes, and documentation evidencing the participant's professional credentials.
3.2 Enrollment requests are reviewed before an account is activated. Validation typically takes one (1) to two (2) business days. A participant's account becomes active, and the participant may begin earning points, upon receipt of the Program welcome email confirming that the registration has been validated.
3.3 The Site uses passwordless sign-in. Participants sign in by entering the email address used at enrollment and the one-time code sent to that email address. Participants are responsible for maintaining the security of their email accounts and for all activity conducted through their Program accounts.
3.4 Participants must keep their account information current, including their mailing address and email address. Rewards are delivered to the email address on file, and tax documents are issued using the information on file.
4. Earning Points
4.1 Validated sales. A participant earns one (1) point for each U.S. dollar of the published list price of Eligible Products (for one (1) Canadian dollar for purchases in Canada) shown on a valid invoice submitted through the Site and approved by the Administrator. Points are calculated based on the published list price in effect at the time of approval, regardless of the actual price paid. Points are not awarded on taxes, shipping, installation, services, or products that are not Eligible Products.
4.2 Eligible Products. "Eligible Products" means the GROHE SPA products identified on the Eligible Products list published on the Site, as updated by LIXIL from time to time. LIXIL may add or remove products from the Eligible Products list at any time. Participants will have 60 days passed discontinuation of an item to claim sales.
4.3 Invoice requirements. To be approved, an invoice must be a legible, system-generated invoice or receipt from the selling showroom or dealer that clearly shows the seller's name, invoice number, invoice date, products purchased (by SKU or description), and quantities. Handwritten invoices, quotes, estimates, order confirmations and altered documents are not accepted. Invoices must be submitted within sixty (60) days of the invoice date. Each sale may be entered once. A file containing more than one invoice is treated as a single submission.. Invoices for purchases made before the participant's account was activated are not eligible unless otherwise stated by LIXIL on the Site. LIXIL may reject any submission that it determines, in its sole discretion, contains fraudulent, misleading, altered, or falsified information or documentation. LIXIL may suspend or terminate the participant’s account and pursue any other remedies available under applicable law in response to fraudulent activity or violations of these Terms and Conditions.
4.4 Eligible sales. Points are awarded for GROHE SPA products specified by the participant and sold for installation in a client's residence. Commercial sales are not eligible, including sales for multi-family projects or condominium complexes, bulk sales to builders, sales to kitchen and bath dealers or distributors for resale, and internet sales. Returned, cancelled or refunded products are not eligible, and any points previously awarded for such products may be reversed. Optional anti-abuse limit mirroring EMR: a maximum of six (6) units of any one SKU per invoice are eligible for points.
4.5 Promotional periods. From time to time, LIXIL may offer promotional periods during which sales of designated products, or other qualifying activities may earn additional points, as stated on the Site. Promotional points are subject to the dates, Eligible Products lists, and any limits published for each promotion.
4.6 Design for Us (specifications). As an introductory offer, a participant earns 500 points for each approved client specification that includes at least one (1) Eligible Product. An approved specification must be on the participant's company letterhead and include the participant's name, the client or project name, and the date of creation. Approval is limited to five (5) specifications per participant per calendar month and fifteen (15) specifications in total until the participant's first approved validated-sale claim. Duplicate or substantially similar specifications are not eligible. If a specification is later found to be invalid, duplicate, or substantially similar, any points, money, or other rewards awarded for it will be forfeited or returned. LIXIL may modify or discontinue this offer at any time by providing notice on the Site.
4.7 Engagement activities. Participants may earn the number of points stated on the Site for completing other activities, which may include completing a profile, following GROHE on Instagram™, publishing eligible social media content, sharing GROHE content, submitting a product review through LIXIL's review provider, and completing Learn and Earn training modules with a passing score. Point values, frequency limits, and eligibility requirements, and other conditions are stated on the Site and may change. LIXIL may verify eligibility and compliance with these requirements and may deny, revoke, or deduct points for activities that are ineligibility, invalid, duplicated, fraudulent, improperly completed, or otherwise fail to meet the applicable requirements.
4.8 Social media. To earn points for social media activities, a participant must connect or provide their public social media handle. Content must remain public and comply with the applicable platform's terms. By participating in a social media activity, the participant consents to LIXIL verifying the activity through the participant's public profile and grants LIXIL a non-exclusive, royalty-free license to display content the participant submits in connection with the Program. Participants must clearly and conspicuously disclose their material connection with LIXIL, including by using the required disclosure hashtag #myGROHEdesign at the end of applicable posts, and comply with applicable Federal Trade Commission (FTC) guidelines. Disclosures must appear in close proximity to the applicable statements. Participants may make only factual statements about LIXIL and/or GROHE or its products that they know to be truthful and can be verified.
4.9 Referrals. Referral rewards are not offered at launch. If LIXIL introduces referral rewards in the future, the applicable terms and conditions will be posted on the Site.
5. Review and Approval of Claims
5.1 Claims are reviewed for eligibility and accuracy. Most approved claims are credited with points within one (1) hour. Claims selected for additional review may take up to two (2) business days to process, or longer if additional information is required.
5.2 The Administrator may approve, place on hold, or decline any submission and may request additional information or documentation. A submission may be declined or placed on hold if, for example: the invoice does not show an Eligible Product; the invoice has already been submitted; the document is illegible or appears to have been altered; or the purchase is for a commercial project or for resale.
5.3 If a participant believes an Eligible Product on an approved invoice was not credited, the participant may contact Program support and provide the submission ID and product details. The Administrator will review the claim and, if the product is determined to be eligible, credit the applicable points.
5.4 Validation of each claim and any points earned are subject to verification by the Administrator on LIXIL's behalf. All determinations are made in LIXIL's sole discretion and are final and binding. Points awarded in error may be reversed.
6. Points Value and Redemption
6.1 Each point has a redemption value of $0.01 in the currency of the participant's country of enrollment (U.S. dollars for participants in the United States and Canadian dollars for participants in Canada).
6.2 A participant must have at least 500 points to redeem. Points may be redeemed only in whole-dollar amounts (in increments of 100 points). Any remaining points will remain in the participant's account.
6.3 Rewards available at launch are a digital Visa prepaid card and an Amazon.com (United States) or Amazon.ca (Canada) electronic gift card, each delivered by email to the address on file. Rewards are issued by third-party providers and are subject to the applicable issuer’s terms and conditions, including any expiration date, fees, or other restrictions stated by the issuer. A prepaid card must be activated in accordance with the card provider's instructions before it may be used. Once a prepaid card is issued and activated, the participant is responsible for safeguarding the card and its funds. The participant must promptly report any lost, stolen or compromised card to the card provider in accordance with the provider’s instructions. Neither LIXIL nor the Administrator is responsible for replacing or restoring the value of funds lost after delivery of the card.
6.4 Points have no cash value, may not be transferred, sold, or combined with another account, and may not be exchanged for cash except where required by law. LIXIL may add, change, or remove reward options at any time.
6.5 Redemptions may be delayed or suspended while an account is under review pursuant to Section 8.
7. Point Expiration and Account Inactivity
7.1 Points expire after twelve (12) consecutive months during which the participant neither earns nor redeems any points. All points also expire when the participant’s account is closed or terminated.
7.2 LIXIL may close an account that has been inactive for twelve (12) consecutive months after providing notice to the email address on file.
8. Program Integrity
8.1 Participants may not submit invoices or specifications that are altered, fabricated, duplicated, or that relate to purchases the participant did not make or specify. Participants may not create multiple accounts, use automated means to interact with the Site, or otherwise attempt to obtain points or rewards through misrepresentation.
8.2 Where LIXIL or the Administrator reasonably suspects a violation of these Terms, LIXIL may place the account under review. While an account is under review, all submissions are subject to manual approval, and redemptions may be suspended. LIXIL may reverse points, cancel rewards, recover the value of rewards obtained in violation of these Terms, and suspend or terminate the account, and any other remedies available to LIXIL under applicable law.
9. Taxes
9.1 Rewards may constitute taxable income to the participant. Where required by law, the Administrator will issue IRS Form 1099 (United States) or a T4A slip (Canada) to participants, using the Social Security Number or Social Insurance Number and address provided at enrollment. Participants are solely responsible for any taxes arising from their participation in the Program and for providing accurate and complete tax information.
10. Privacy and Communications
10.1 Personal information collected in connection with the Program is collected by the Administrator on behalf of LIXIL and is used to operate the Program, validate claims, deliver rewards, provide support, meet tax reporting obligations, and communicate with participants. Personal information is handled in accordance with the LIXIL Privacy Policy at https://www.grohe.us/pages/privacy-policy and, with respect to the Administrator's processing, the Bubblehouse Privacy Policy at www.bubblehouse.com/privacy-policy.
10.2 Social Security Numbers, Social Insurance Numbers and related tax information are used solely for tax reporting purposes and are maintained with restricted access.
10.3 By enrolling, participants agree to receive transactional and administrative emails relating to their participation, including enrollment, claim status updates, account notices, and reward delivery notices.
10.4 Participants may separately opt-in to receive marketing communications about the Program and GROHE products, services, or other offerings. For participants in Canada, the opt-in constitutes express consent to receive commercial electronic messages from LIXIL in accordance with applicable law. Participants may withdraw their consent to receive marketing communications at any time by using the unsubscribe link included in any such message. Withdrawal of consent will not affect the participant’s ability to participate in the Program or receive transactional and administrative communications relating to the participant’s account.
10.5 Personal information of participants in Canada may be transferred to, stored in, and processed in the United States. Personal information transferred to the United States may be subject to access by U.S. federal, state, or other authorities in accordance with applicable law.
11. Changes to the Program
11.1 LIXIL may modify these Terms, the Eligible Product list, point values, earning rules, frequency limits, reward options, and any other feature of the Program at any time. Changes take effect when posted on the Site, unless a later effective date is stated. A participant’s continued participation in the Program after a change takes effect constitutes acceptance of the revised Terms or Program feature.
11.2 LIXIL may suspend or terminate the Program at any time. If the Program is terminated, LIXIL will post notice on the Site, and participants will have at least thirty (30) days from the date of such notice to redeem accumulated points. After that period, any unredeemed points will be forfeited, except where prohibited by applicable law.
12. General Terms
12.1 The Program is void where prohibited by law. Participation in the Program is subject to all applicable federal, state, provincial, and local laws and regulations.
12.2 The Site and the Program are provided on an "as is" and “as available” basis. To the fullest extent permitted by law, LIXIL and the Administrator disclaim all warranties, express or implied, relating to the Site and the Program, LIXIL and the Administrator are not responsible for lost, late, incomplete, or misdirected submissions; technical failures of any kind; or for the acts or omissions of third-party reward issuers.
12.3 To the fullest extent permitted by applicable law, Participants agree to indemnify and hold harmless the Company, the Administrator, and their respective affiliates, officers, directors, employees, agents, and representatives from and against any third-party claims, damages, losses, liabilities, costs, and reasonable attorneys’ fees arising out of or relating to Participant’s breach of these Terms, violation of any law or third-party right in connection with the Program, violation of applicable law, or fraudulent, deceptive, or improper activity in connection with the Program. LIXIL and the Administrator reverses the right to assume the exclusive defense and control of any matter subject to indemnification, and Participant agrees to reasonably cooperate with LIXIL and the Administrator in the defense of any such claim. Participant may not settle any claim subject to the indemnification without LIXIL’s or the Administrator’s prior written consent if the settlement imposes any obligation or liability on LIXIL or the Administrator.
12.4 To the fullest extent permitted by applicable law, LIXIL and the Administrator will not be liable to a participant for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, or goodwill, arising out of or relating to the Program, the Site, or any reward, even if advised of the possibility of such damages. To the fullest extent permitted by applicable law, the aggregate liability of LIXIL and the Administrator to a participant arising out of or relating to the Program, the Site, or any reward will not exceed the redemption value of the points in the participant's account at the time the claim arose. Nothing in these Terms is intended to limit or exclude any rights or protections that Participants are entitled to under applicable consumer protection law.
12.5 By participating in the Program, participants agree that these Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Participants residing in Canada remain entitled to the benefit of the mandatory consumer protection laws applicable in their province or territory of residence. Any dispute, claim, or controversy arising out of or relating to these Terms or the Program will be resolved in the courts located in the State of New Jersey, and Participants consent to the jurisdiction and venue of such courts, except to the extent that applicable law requires otherwise.
12.6 If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. LIXIL’s or Administrator’s failure to enforce any provision of these Terms will not constitute a waiver of that provision or the right to enforce it in the future.
12.7 Participants may not assign or transfer their rights or obligations under these Terms without LIXIL’s prior written consent. LIXIL may assign or transfer these Terms or its rights and obligations under these Terms without notice to Participants.
12.8 All content on the Site, including text, graphics, logos, images, software, and the compilation and arrangement onthe Site, is the property of LIXIL, the Administrator or their respective licensors and is protected by copyright, trademark and other applicable intellectual property laws.
12.9 Participants may use the Site solely for the purpose of participating in the Program. Except as expressly permitted in these Terms or with the prior written permission of LIXIL, Participants may not copy, reproduce, modify, adapt, distribute, publish, transmit, display, create derivative works from, or otherwise use any Site content for any other purpose.
12.10 Participants may not reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive the source code, underlying ideas, algorithms, or structure of any software or technology used to operate or provide the Site or Program, except to the extent that such restriction is prohibited by applicable law. Participants may not circumvent, disable, or interfere with any security, access-control, or technological, protection measures used in connection with the Site or Program. Any violation of this provision may result in immediate suspension or termination of Participant’s participation in the Program, forfeiture of all points and rewards in Participant’s account, and any other remedies available to LIXIL and the Administrator under applicable law.
12.11 LIXIL and the Administrator make reasonable efforts to provide accurate product descriptions, pricing, point values, reward amounts, and other Program information, but do not warrant that such information is complete or error-free. LIXIL or Administrator reserves the right to correct any error and recalculate, withhold, cancel, or reverse points or rewards resulting from such error. Participants are not entitled to points, rewards, or other benefits credited or issued solely due to an error.
12.12 GROHE, GROHE SPA, and related marks are trademarks of the LIXIL group. Visa is a trademark of Visa International Service Association. Amazon and Amazon.ca are trademarks of Amazon.com, Inc. or its affiliates. The issuers of rewards are not sponsors of, affiliated with, or otherwise associated with the Program, unless expressly stated otherwise.
12.13 By participating in the Program, Participants consent to receiving Program-related communications electronically, including by email, through the Site, or through the Participant’ Program account. Participants are responsible for keeping their contact and account information accurate and up to date. Electronic communications will satisfy any legal requirement that such communications be provided in writing, to the extent permitted by applicable law.
12.14 These Terms, together with any other terms or policies expressly incorporated by reference, constitute the entire agreement between the Participant, LIXIL and the Administrator regarding the Program and supersede all prior or contemporaneous agreements, understandings, or communication relating to the Program.
